Emile Rassam Ltd, a limited liability company, incorporated in Nicosia (Cyprus) (“Emile Rassam” or “we”, “us”, “our”) is an international provider of high-quality image clothing with significant presence across the MENA region, Europe, and Asia. Emile Rassam operates this store and website to enable individuals and corporations (“Customer” or “You”) to access, customize, and purchase a wide range of professional uniforms and image wear (“Products”) and provide them with a curated shopping experience (“Services”).
By accessing or using our website at emilerassam.com (“Site”) you agree to comply with and be bound by these terms and conditions (“Terms”).
You are also agreeing to our Privacy Policy and any other rule on the Site, which are to be read in conjunction with these Terms.

The Services are operated by Emile Rassam using certain third-party service providers as further detailed in Clause 5.4 and Clause 8 below.
1. Customer Eligibility
Age requirement: Customers that are individuals must be at least 18 years old to use our Services.
2. Account Registration, Deletion, and Termination
2.1 Account Creation
To access certain features, You have to create an Account through our Services.
2.2 Customer Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Emile Rassam immediately of any unauthorized use of your account.
2.3 Know Your Customer Compliance (KYC)
Customers are required to comply with all KYC obligations as mandated by the applicable laws and regulations.
Emile Rassam reserves the right to request information and documentation to verify the identity and legitimacy of Customers, in accordance with the requirements of the applicable laws and regulations. Failure to provide the necessary information or to comply with these obligations may result in the suspension or termination of access to the account without liability on the part of Emile Rassam. The suspension or termination of access to an account does not eliminate the obligations of the Customers under those Terms.
2.4 Account Deletion
You may delete Your account at any time through your account settings. However, please be aware that doing so will not necessarily result in the automatic removal of Your information from our Services. Emile Rassam reserves the right to retain certain information as needed for legitimate business purposes, including compliance with legal obligations and enforcement of our Terms. These Terms will continue to apply to your prior and ongoing use of our Services, even after account deletion.
2.5 Account Termination
Emile Rassam reserves the right to suspend or terminate Your account if You violate the applicable laws and regulations, these Terms, or if an unlawful or fraudulent activity is suspected.
3. Use of our Services

You may use our Services only for lawful purposes, such as make enquiries and place valid orders in compliance with applicable laws and regulations.

3.2.3 Engage in fraudulent, deceptive or misleading practices.

It is to be noted that in the case of any prohibited use of the Services, Emile Rassam is entitled at its sole discretion to immediately suspend or terminate Your access to the Services and reserves the right to initiate any legal action where applicable.
4. Intellectual Property
All content and materials available on the Services, including but not limited to drawings, designs, illustrations, photographs, sound tracks, written text, logos, trademarks and all other intellectual property of any nature whatsoever (“Intellectual Property”), are the sole and exclusive property of Emile Rassam. You may not sell, reproduce, process, distribute, publish, transmit, or modify any Intellectual Property contained on the Services.
Emile Rassam remains the owner of the creations relating to the Products displayed on the Site, Application or otherwise. These Terms do not grant the Customer or any other person any rights or entitlements of any kind whatsoever to the Intellectual Property owned and held by Emile Rassam.
The contents of all such Intellectual Property shall remain with Emile Rassam or the corresponding third-party providers who make them available.
5. Data Protection and Privacy
5.1 Data collection: we collect personal data as described in our Privacy Policy.
5.2 Data use: collected data is used to operate and improve the Services, and for all the other purposes outlined in the Privacy Policy.

6. Limitation of Liability
To the fullest extent permitted by applicable laws and regulations, Emile Rassam will not be liable to You, or to any third party for any damages including but not limited to indirect, incidental, exemplary, punitive, special or consequential damages, such as loss of profits, loss of goodwill or any other intangible losses, arising out of or in connection with Your use or inability to use the Services, except where such liability or damage is the direct result of the gross negligence, fraud, or willful misconduct of Emile Rassam.
7. Platform and Third-Party Services
7.1 Use of Third-Party Platform
The Services may be may be operated, hosted, supported, or made available through third-party service providers (including Shopify, etc..).
By using the Services, You acknowledge and agree that certain features, functionalities, and operations of the Site (including without limitation checkout, payment processing, hosting, and data storage) are provided through such third-party platform and are subject to its applicable terms, policies, and technical limitations.
7.2 Merchant of Record
All sales of Products made through the Site are concluded solely between Emile Rassam and the Customer. Emile Rassam acts as the sole seller and merchant of record.
7.3 Payment Processing
Payments made through the Services may be processed through third-party payment service providers.
Emile Rassam does not control and shall not be responsible for payment authorization failures, processing delays, payment gateway outages, security or any technical malfunction of third-party payment systems.
7.4 Service Availability
The availability and performance of the Services may be affected by the performance, maintenance, interruptions, outages, or technical limitations of third-party service providers.
Emile Rassam does not warrant that the Services will be uninterrupted, continuously available, secure, or error-free at all times.
Emile Rassam shall not be liable for any interruption, delay, unavailability, defect, loss of data, cyber incident, or degradation of the Services resulting from or attributable to third-party providers or infrastructure.
7.5 Compliance with Third-Party Platform Policies
The use of the Services is subject to compliance with the applicable policies of the third-party service providers, including any acceptable use policies or technical requirements imposed by such platform.
Emile Rassam reserves the right to suspend or restrict access to the Services where necessary to comply with requirements imposed by third-party service providers supporting the operation of the Services.
7.6 Limitation of Liability
Without prejudice to the general limitation of liability set out in these Terms, Emile Rassam shall not be liable for any direct or indirect damages, losses, or claims arising out of or in connection with:
7.6.1 the use, failure, or unavailability of the third-party service provider’s platforms;
7.6.2 any payment processing errors, delays, security incidents, malware, cyberattacks attributable to third-party service providers;
7.6.3 the acts or omissions of any third-party service provider.
8. Indemnification:
You agree to indemnify and hold Emile Rassam harmless from and against any claims, damages, or losses arising from your use of the Services or any breach of these Terms or breach of any of the applicable laws and regulations or third-parties rights.
9. Severability
If any provision of these Terms are determined to be invalid, illegal, or unenforceable, the validity, legality ad enforceability of the remaining provisions shall remain in full force and effect.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Cyprus. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Cyprus.
